Based on Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the "Regulation"), we inform you that:

The Contractor processes your personal data for the following purposes:

  • Execution of the concluded contract for the sale and installation of photovoltaic systems (legal basis: Art. 6(1)(b) of the Regulation);
  • Implementation of the "Referral Program" (legal basis: Art. 6(1)(a) of the Regulation);
  • Fulfillment of the legal obligations imposed on the Contractor in connection with the conduct of business activities and the execution of concluded contracts (legal basis: Art. 6(1)(c) of the Regulation);
  • Establishment, pursuit, or defense of claims (legal basis: Art. 6(1)(f) of the Regulation);

In connection with the processing of data for the purposes indicated in point 3, your personal data may be shared with other recipients or categories of recipients of personal data. The recipients of your data may include:

  • Entities authorized to receive your personal data based on relevant legal provisions;
  • Entities that process your personal data on behalf of the Contractor under a personal data processing agreement concluded with the Contractor to provide services specified in the agreement, e.g., subcontracting entities, accounting services, IT services (so-called data processors).

Your personal data will be processed for the period necessary to achieve the processing purposes specified in point 3, i.e.:

  • In the scope of the contract for the sale and installation of photovoltaic systems concluded with you, until the completion of its execution, and after that for a period of 5 years, and in the scope required by law or for securing potential claims;
  • In the scope of the "Referral Program" you have joined, for the duration of the program, and in the scope required by law or for securing potential claims;
  • In the scope of fulfilling legal obligations imposed on the Contractor in connection with conducting business activities and executing concluded contracts, until the Contractor fulfills these obligations;
  • In the scope of establishing, pursuing, or defending claims—for the period necessary for such establishment, pursuit, or defense of claims;

In connection with the processing of your personal data by the Contractor, you have the right to:

  • Access the data, based on Art. 15 of the Regulation;
  • Rectify the data, based on Art. 16 of the Regulation;
  • Delete the data, based on Art. 17 of the Regulation;
  • Restrict the processing of the data, based on Art. 18 of the Regulation;
  • Object to the processing of the data, based on Art. 21 of the Regulation;
  • Transfer the data, based on Art. 20 of the Regulation.

In cases where you believe that the processing of your personal data by the Contractor violates the provisions of the Regulation, you have the right to file a complaint with the supervisory authority (i.e., the President of the Personal Data Protection Office).

To the extent that the processing of your data occurs to conclude and execute the contract for the sale and installation of photovoltaic systems, providing your data is necessary for the conclusion and execution of this contract. Providing the data is voluntary, but failure to provide this data will result in the inability to conclude and execute the aforementioned contract.

The Contractor declares that your data will not be used for profiling or automated decision-making.

The Contractor will not transfer your personal data to a third country (outside the European Union or European Economic Area) or international organizations.

Admission 

As the owner of wp2.investments (hereinafter referred to as the "Website"), we respect your rights and make every effort to protect your privacy. Detailed regulations related to this are included in this document (hereinafter referred to as the "Privacy Policy"), which we have been adopting since the creation of the Website.  

With reference to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of data, we inform below how we will process, secure and use personal data collected in the following situations: 

  1. data collected about people visiting the Website (e.g. using cookies), 
  2. data collected by contact forms available on the Website, 
  3. data collected during contact by phone, email, Linkedin or other messengers, 
  4. data collected when subscribing to the newsletter, 
  5. data collected and provided to us by third parties (e.g. external service providers, participants in promotional campaigns), 
  6. data collected during the recruitment process, when the candidate contacts the Website or sends the CV directly to WP2 Investments Sp. z o.o. 

 In the event that personal data is collected in situations other than those described above, the Company will separately inform about how it will process this information. 

  1. Personal Data Administrator

1.1. The administrator of your personal data processed in accordance with this Privacy Policy is WP2 Investments Sp. o.o., with its registered office at 55-040 Bielany Wrocławskie, Irysowa 1, KRS0000879911, REGON 387987621, NIP 8961600490 (also referred to in the Privacy Policy as "the Company", "We" or "Administrator").

  1. Purpose and legal bases of processing

We will process your personal data that we obtain in situations covered by this Privacy Policy for the following purposes: 

  • responding to inquiries addressed to us using contact forms or to messages sent to our contact details visible on the Website – based on our legitimate interest as the administrator of personal data, 
  • analysing the use of the website, as well as improving its functioning and security – based on our legitimate interest as the administrator of personal data, 
  • to pursue and defend against claims, before courts and administrative authorities and outside of them – based on our legitimate interest as a personal data administrator, 
  • direct marketing of products or services – based on our legitimate interest in the event that we are connected by an existing business relationship, and in the event that we are just about to establish such a relationship – based on your consent, 
  • to send newsletters – based on our legitimate interest in the event that you subscribe to our newsletter, 
  • in the event of concluding a contract with you for the provision of services or delivery of goods by us – based on the fact that these data are necessary for the conclusion and subsequent performance of the agreement, including its settlement, 
  • in the case of concluding a contract with an entity with which you are related (e.g. as a person representing this entity or a person performing a contract on behalf of and for the benefit of this entity) – based on our legitimate interest as the administrator of personal data, 
  • data archiving and backup – in connection with the obligation imposed on us as the data controller to properly secure the data and based on our legitimate interest as the administrator of personal data. 
  1. Data processed for the purpose of contact – scope of processing

If you decide to contact us using the contact form available on our websites, the e-mail addresses provided, phone numbers, our LinkedIn page or traditionally by post or in person, as well as in situations where we have the right to contact you (e.g. for marketing purposes), we will process such personal data that you provide to us (your contact details,  the content of the message or a transcript of the conversation) or are necessary to respond to your inquiry (including identification and contact data, as well as IP address in the case of using the contact form on our Website), or which we have in connection with the relationship between us or received from third parties (including companies providing services in the field of support for marketing activities),  or call center, or from commonly available sources). We process this data due to the fact that it is necessary to pursue the legitimate interests of the Administrator, i.e. for the purpose of: 

  • Reply to a message you send us and contact you further. 
  • direct marketing of our own products and services and those of third parties (in a situation where we do not have your consent to process data for marketing purposes), 
  • archiving and backing up data in connection with the obligation imposed on us as the data controller to properly secure the data), 
  • settlement of contracts with our contractors who provide us with contact support services, such as call center or IT services, 

or: 

  • based on your consent – where this data is used for marketing purposes and we are not connected by an existing business relationship, or when it is collected for the purpose of transferring it to third parties. 
  1. Data processed in connection with the use of the Website – scope of processing

When you use our Website, we record information about how you use our Website and previously visited pages, as well as information about the choices you make (e.g. with regard to cookies). In most cases, we will not be able to identify you as a user and this data will be anonymous to us. If, on the other hand, we are able to link it to you, which may happen if we have additional data from another source (e.g. we will save such data when you contact us using the contact form on our Website), they become your personal data for us. We process this data: 

  • due to the fact that they are necessary for the purposes resulting from the legitimate interests pursued by us, this is in particular: 
  1. adjust the way the Website is displayed and personalize it, 
  1. analysis of behavior on the website, including to improve its functioning and security, 

or: 

  • based on your consent – where this data is used for marketing purposes and we are not connected by an existing business relationship, or when it is collected for the purpose of transferring it to third parties. 
  1. Data collected when subscribing to the newsletter – scope of processing

If you provide us with your contact details in order to subscribe to the newsletter, this will be tantamount to us of you giving us consent to send commercial information contained in this newsletter by electronic means (e-mail). The processing of data for this purpose will be based on our legitimate interest, i.e. the execution of the newsletter that you order by subscribing to this service. 

 

  1. Data collected during recruitment – scope of processing

In the event that you decide to send us your application documents and participate in the recruitment process using the contact details available on the Website, we will save the information about you contained in these documents. To the extent that they are included in the catalogue indicated in Article 221 of the Labour Code, the basis for their processing is this provision of law. If you provide us with more information (e.g. a photo of yourself), we will understand your behaviour as consent to the use of this information for recruitment purposes.  

  1. Data collected in connection with the conclusion or performance of an agreement with the Administrator (including acceptance of the terms and conditions) – scope of processing

If the Administrator enters into an agreement with you, your personal data may be necessary for its conclusion and performance. The conclusion of an agreement for the purposes of this Privacy Policy should also be understood as acceptance of the terms and conditions published by the Administrator, e.g. the regulations of promotions organized by the Administrator. The Administrator may also collect your data if you are a person acting on behalf of and for the benefit of a party to the agreement with the Administrator and process them both in connection with its conclusion or for the purposes of its performance. In the first case, the data is usually collected directly from you as a party to the contract and may also be obtained as a result of the activities of marketing service providers or call centers, as well as from people participating in referral programs carried out by the Administrator. In the latter case, your data is generally received from the contracting party or from publicly available sources. These data are processed by the Administrator due to the fact that they are necessary for the conclusion, performance and settlement of the agreement, as well as due to the legitimate interests of the Administrator, including when you are not a party to the concluded agreement, but your data are needed to conclude or perform it, to defend against possible claims or pursue possible claims related to the agreement. 

  1. Period of data processing

Your personal data will be processed: 

  • to contact you – from the date of their collection until the end of correspondence in the matter in which you have made contact, 
  • for marketing purposes – for the duration of our legitimate interest, i.e. the existence of the relationship between us, or until the consent is withdrawn, if it has been granted to us, 
  • for the purposes related to the concluded agreement – for the time necessary for its performance and settlement, 
  • for the purposes of pursuing and defending against claims – for a period not longer than the limitation period of these claims or their pursuit before the competent entities, 
  • for the purpose of performing the obligations imposed by law – for no longer than the time necessary in accordance with these regulations to demonstrate that these obligations were performed by the Administrator, 
  • for the purpose of improving the functioning and security of our Website – for the time for which the data are necessary to achieve this purpose, but no longer than until you express an effective objection to their processing, 
  • for the purpose of sending the newsletter – from the day of subscribing to the time you express an effective objection to their processing (unsubscribing from the newsletter) 
  • for the purpose of archiving and making backup copies – for a period determined in accordance with the backup and archiving policy at the Administrator, 
  • for recruitment purposes – for the duration of the recruitment process, but not longer than for 6 months from the receipt of your application documents, unless the recruitment process takes longer, you are employed or you give us your consent to process this data for future recruitment purposes. After the expiry of the indicated 6 months, this data will be archived and stored for no longer than 3 consecutive years – solely for the purpose of implementing the backup and archival policy and for the purpose of pursuing and defending against possible claims. 
  1. Data recipients

We will exercise due diligence in the selection of entities to which we will transfer your data, and, in the case of such selected entities, we will require them to protect your data using appropriate technical and organizational measures. Your personal data may only be disclosed: 

  • third parties providing services to us that are necessary to achieve the purposes for which we process your data (e.g. IT services, call center, recruitment, electronic communication, including sending e-mails, hosting, law firms, accounting companies), 
  • recipients for whom disclosure is required by applicable law or by order of a court or other authority. 
  • other recipients, if you have given your consent to them or where the provision of the data is necessary to protect your vital interests or those of other natural persons or for the common good. 
  1. Transfer of personal data to third countries

Your personal data may be transferred to entities with which we cooperate. Whenever your personal data is transferred outside the European Economic Area (EEA) or to countries that do not provide the same or adequate level of protection for personal data, we will ensure that this is done on a valid legal basis and with the safeguards required by law. 

  1. Eligibility

Within the scope of each of the rights indicated below, you can contact us in particular using the contact details provided in point 1 of the Privacy Policy. You are entitled to: 

  • The right to obtain information, access data and receive a copy of the data. You have the right to request information about your personal data that we hold or have access to at any time. Upon your request, you will be provided with a copy of your personal data subject to processing free of charge. We have the right to request a fee for each subsequent copy of the data, which will cover the reasonable costs of handling such a request. 
  • Right to withdraw consent.  Each time your data is processed on the basis of your consent, you have the right to withdraw this consent at any time, whereby the withdrawal of consent will not affect the lawfulness of the data processing before your withdrawal of consent. 
  • The right to rectify your personal data. We take reasonable steps to ensure that your personal information is accurate, complete, and up to date. If changes are necessary to make changes to this data, please let us know. 
  • Right to data portability. You have the right to request the portability of your personal data in a structured, commonly used and machine-readable format, as well as to request the transfer of data to another controller, where the basis for the processing of your personal data is your consent. 
  • Right to erasure and restriction of processing. In the cases indicated in the data protection regulations, you have the right to request the deletion of your personal data. However, this right is not absolute – there may be situations where we are still entitled to process your personal data. You can also request the restriction of further processing of your data. 
  • Right to object to processing. In the cases indicated in the regulations, you have the right to object to further processing of your data, in a situation where the basis for the processing of personal data is our legitimate interest. 
  • The right to lodge a complaint with a supervisory authority. You have the right to lodge a complaint with the supervisory authority dealing with the protection of personal data – as a rule, it will be the President of the Office for Personal Data Protection. 
  1. Policy on the use of cookies and other similar technologies

Our Website uses cookies (small text files that are handled by our website and stored on your device) and other similar technologies, including: tools from Google Inc.: Google Analytics. The entity using these tools is the administrator of the Website, i.e. WP2 Investments Sp. o.o., with its registered office at 55-040 Bielany Wrocławskie, Irysowa 1, KRS0000879911, REGON 387987621, NIP 8961600490 (hereinafter: "We"). 

The Website uses the indicated tools for various purposes, including: 

  • to adjust the way our Website is displayed to the devices, software and preferences of users and the settings selected by them, 
  • to monitor how users use the Website and the possibility of improving its functioning, 
  • to personalize the content offered, 
  • to target more relevant content to users through other websites. 

We use the following types of cookies: 

  • analytical cookies that examine the behavior of the user of our Website; 
  • functional cookies enabling the memory of the settings selected by the user and personalization (e.g. in terms of the selected language or acceptance of cookie settings); 
  • third-party cookies – third-party cookies may also be stored on the devices used, marketing cookies used to adjust the displayed ads to preferences. Our partners (Google Inc.) use cookies for advertising and remarketing purposes. They may use cookies to show users content, including ads tailored to their preferences. 

Cookies and other tools used by us are not used to process or store personal data and are not intended to directly identify you. They also do not change the user's browser settings or change the configuration of the user's device. Exceptional situations, when data collected with the use of cookies may be considered, your personal data, as well as your related rights, are described in detail in the relevant part of the Privacy Policy. 

Ways to disable cookies 

By accessing our Website, you have the opportunity to consent to the use of cookies for marketing purposes and cookies from third parties. Even if you have already given your consent, you can use the options described below.
